    Qualified vs. unqualified provider<\/strong><\/span><\/h2>\n

The regulation of both is found in the eIDAS Regulation and is maintained in its evolution eIDAS2.     Accreditation after a rigorous audit<\/strong><\/span><\/h2>\n

    [\/vc_column_text][vc_column_text]\"AENOR\"In order for the provider to be considered qualified and be included in the ministry’s trusted list to be able to start the activity, it must undergo a conformity assessment, and obtain a positive report, by a national accreditation body<\/strong>. The audit, which is very rigorous, examines the processes and procedures that the applicant company has in place to ensure the security of its electronic service. It also verifies compliance with the European technical standards ETSI involved in the service in question, as well as in the legal, organizational and technical fields.<\/p>\n

    Once this analysis has been completed, qualified providers must submit the aforementioned report to the ministry at least every twenty-four months.     Qualified reliable services<\/strong><\/span><\/h2>\n

    [\/vc_column_text][vc_column_text]EU Regulation 910\/2024 eIDAS recognizes the following as qualified trust services:<\/strong><\/p>\n

    1. Issuance of Certificates of electronic signatures \/ seals<\/li>\n
    2. Time stamps<\/li>\n
    3. Certified electronic delivery<\/li>\n
    4. Validation of electronic signatures\/seals<\/li>\n
    5. Preservation of signatures \/ electronic seals<\/li>\n
    6. Website authentication<\/li>\n<\/ol>\n

      Unlike a qualified trust service provider, a non-qualified trust service provider may offer trust services, but is not obliged to comply with rigorous and constant controls by the designated supervisory body in each Member State<\/strong>. Trust is, therefore, lower.<\/strong><\/p>\n

      Such is the trust placed in the qualified provider that, in the event of litigation, his evidence enjoys a rebuttable presumption when presented as evidence<\/strong>. In other words, it is up to the opposing party to prove that the service was not properly rendered and that the evidence is therefore invalid.
